Copyright

As quoted by Copyright Office of India, Copyright is a right given by the law to creators of literary, dramatic, musical and artistic works and producers of cinematograph films and sound recordings. In fact, it is a bundle of rights including, inter alia, rights of reproduction, communication to the public, adaptation and translation of the work. There could be slight variations in the composition of the rights depending on the work.

Copyright ensures certain minimum safeguards of the rights of authors over their creations, thereby protecting and rewarding creativity.

DOCUMENTS REQUIRED TO FILE COPYRIGHT

Artistic Work

  • Two copies of the work
  • Author’s NOC if the applicant is different from the author
  • Publisher’s NOC if the work published and publisher is different from the applicant
  • Certificate from the trademark office (TM -60) if the work is being used on the goods or capable of being used on the goods
  • NOC from the individual whose photograph appears on the work

Music

  • Two copies of work (graphical notes)
  • NOC from the publisher if the work published and publisher is different from the applicant
  • Author’s NOC if the applicant is other than the author

Sound Recording

  • Two copies of the work
  • NOC from different copyright holders or copy of the agreement (deed of assignment)
  • NOC from the publisher if the work published and publisher is different from the applicant

Cinematograph Film

  • Two copies of the work
  • NOC from different copyright holders or copy of the agreement (deed of assignment)
  • NOC from the publisher if the work published and publisher is different from the applicant

Literary/Dramatic

  • Two copies of the work
  • NOC from the publisher if the applicant is other than the publisher and the work is published
  • Author’s NOC if the applicant is other than the author

Software

  • Two copies of the work
  • Author’s NOC if the author is different from the applicant
  • Source code and the object code of the work for verification
